Climate United Petitions for Rehearing from Full Appeals Court Circuit to Regain Access to Funds
September 10, 2025
Today, Climate United and other GGRF awardees filed a rehearing petition, appealing the recent decision from a three-judge panel of the D.C. Circuit Court. The petition asks the full Circuit Court to hear the case, after the panel ruled 2-1 that the lower court lacked jurisdiction. The petition argues that the panel erred in its ruling by dismissing Constitutional and APA claims, which warrants review by the full court.
Climate United CEO Beth Bafford offered the following statement:
“As time passes, hardworking Americans are paying the real costs of this unnecessary legal battle. Energy bills are rising, and instead of investing in projects that reduce costs, create jobs, and support domestic manufacturing, we are spending months in court. We are taking this next step so we can get back to work.”
